Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of Articulate's Services and supplements the Articulate Online Terms of Service or your negotiated Services Agreement with Articulate Global (the "Agreement"). Capitalized terms used but not defined in this AUP have the meanings given in the Agreement.

By accessing or using the Services, you agree to comply with this AUP. Users must accept this AUP through the account registration process before accessing the Services. You are responsible for ensuring that all Users authorized under your account comply with this AUP.

Articulate may modify this AUP from time to time by posting an updated version at this location. Material changes will be communicated via email or through notification in the Services. Your continued use of the Services after any such update constitutes acceptance of the modified AUP.

1. Appropriate Use of AI Features

If you use our AI-powered features, you agree to the following:

1.1 Prohibited AI Uses. You may not use the Services, AI Features, Articulate Content, or any Output to:

a. Train, improve, fine-tune, or develop any artificial intelligence, machine learning models, or algorithms that compete with Articulate

b. Make automated decisions with legal, employment, financial, or medical consequences

c. Use AI Features for purposes that would cause the Services to be classified as a high-risk AI system under the EU AI Act or similar laws

1.2 Transparency. You may not mislead anyone into believing that AI-generated Output is human-created if applicable law requires that a deployer must disclose that it was created using AI.

1.3 Accuracy. AI Features may produce inaccurate or incomplete results. You are responsible for reviewing all Output before use and must not rely on Output for critical decisions without independent verification.

2. Prohibited Content

You may not upload, share, store, or generate through the Services any content that:

a. Is unlawful, harmful, threatening, abusive, tortious, defamatory, or libelous

b. Violates any applicable laws or regulations

c. Infringes or violates anyone's intellectual property rights or other proprietary rights

d. Is invasive of another person's privacy or violates privacy rights

e. Harms, incites, or encourages violence or hatred against minors, individuals, or groups based on race, ethnicity, religion, disability, gender, age, veteran status, or sexual orientation

f. Promotes or facilitates violence, terrorism, or criminal activity

g. Contains images for which you do not have verifiable parental consent under the Children’s Online Privacy Protection Act (COPPA) or similar applicable laws

3. Prohibited Conduct

You may not use the Services to:

3.1 Fraud, Deception, and Misrepresentation

a. Impersonate any person or entity

b. Falsely state or otherwise misrepresent your affiliation with a person, organization, or entity

c. Engage in phishing, spoofing, or sending altered, deceptive, or false source-identifying information

d. Manipulate or deceive others regarding the source or nature of content

3.2 Spam and Unsolicited Communications

a. Engage in chain letters, junk mail, pyramid schemes, spamming, or other unsolicited messages

b. Use the Services to send bulk unsolicited communications

c. Create distribution or mailing lists using data from the Services without authorization

3.3 Interference and Disruption

a. Disrupt, interfere with, or inhibit any other user from using the Services

b. Compromise the integrity, security, or performance of the Services

c. Introduce or attempt to introduce any viruses, trojans, worms, ransomware, spyware, or other malicious code into the Services

3.4 Review 360 Misuse

a. Use Review 360 as a hosting or distribution solution for delivering content to end users. Review 360 is intended solely for collaborative review and feedback on e-learning content during development.

4. Technical Restrictions

You may not:

4.1 Malicious Code and Harmful Materials

a. Introduce, transmit, or store through the Services or Customer Content any viruses, trojans, worms, ransomware, spyware, or other malicious code

b. Introduce materials or software code that are harmful to the Services or Articulate's software, firmware, or related technology

4.2 Data Mining and Extraction

a. Use any data mining or similar data gathering and extraction methods in connection with the Services

b. Extract or attempt to extract training data associated with any AI Feature

c. Scrape, crawl, or systematically extract data from the Services using automated means

4.3 Unauthorized Access and Circumvention

a. Attempt to gain unauthorized access to the Services or related systems or networks

b. Defeat, avoid, bypass, remove, deactivate, or otherwise circumvent technological measures intended to control access to the Services

c. Develop, distribute, or use products that circumvent technological protection measures

5. Sensitive Data Restrictions

The Services are not designed for and you should not use them to store or process:

a. Sensitive personal information (SPI)

b. Protected health information (PHI) as defined under HIPAA

c. Payment card industry (PCI) data subject to PCI-DSS requirements

d. Classified information or data subject to the International Traffic in Arms Regulations (ITAR)

6. Enforcement

6.1 Investigation and Monitoring

While Articulate is not obligated to monitor Customer Content uploaded to the Services, Articulate reserves the right to investigate suspected violations of this AUP.

6.2 Enforcement Actions

If Articulate determines, in its sole discretion, that you have violated this AUP, Articulate may take any of the following actions:

a. Issue a warning or request that you cease the violating activity

b. Remove or disable access to content that violates this AUP

c. Suspend your access to the Services temporarily

d. Terminate your account and access to the Services

e. Report violations to law enforcement authorities

f. Take legal action against you for damages or injunctive relief

6.3 No Waiver

Articulate's failure to enforce this AUP in every instance does not constitute a waiver of Articulate's rights. Articulate reserves the right to enforce this AUP at its discretion.

7. Changes to This Policy

Articulate may update this Acceptable Use Policy from time to time. When we make changes, we will update the "Effective Date" at the top of this policy. Material changes will be communicated to customers via email or through notification in the Services. Your continued use of the Services after any changes constitutes your acceptance of the updated AUP.
