We are Articulate Global, LLC ("Articulate," "we," "us," or "our"), a provider of tools for workplace learning, located at 244 5th Avenue, Suite 2960, New York, NY 10001, USA. This Privacy Notice describes how we collect, use, share, and store your personal data when individuals visit our websites, access Articulate’s services, participate in our E-Learning Heroes Community, register to attend our events and webinars (online and in person), participate in surveys or sweepstakes, apply to our job postings, contact us through various communication methods, or as otherwise described in this Notice (the "Services"). This Notice also describes your choices as related to your personal data.

Personal Data. Personal data refers to information relating to an identified or identifiable individual, including name, phone number, company name, job, email, and postal address. Articulate does not knowingly collect sensitive or special categories (“Sensitive Data”) of personal data. Users may provide Sensitive Data such as in job applications, by using the Services, or other contexts described in this Notice. For information about facial images and facial geometry processed through Custom Photorealistic Avatars, see the sections on “Biometric Data” and “Custom Photorealistic Avatars” below.
Usage and Diagnostic Data. We automatically collect information about how you access and use our Services (“Usage Data”). This includes both (i) information about your interactions with the Services and (ii) technical and diagnostic information generated by your device or our systems when you use the Services. We, our affiliated entities, our service providers, and our marketing partners collect this data using automated technologies such as cookies, log files, and similar tracking technologies.
Biometric Data. This section only applies if you use the Custom Photorealistic Avatar (defined below) feature in the Services to upload an image or a voice of a real individual. To the extent an applicable data protection law applies to you, when we refer to “Biometric Data” in this Privacy Notice it includes the following potentially applicable definitions:
In General Data Protection Regulation (GDPR), "biometric data" means personal data resulting from specific technical processing relating to the physical, physiological, or behavioral characteristics of a natural person, which allow or confirm the unique identification of that natural person, such as facial images or dactyloscopic data. Under GDPR, only the processing of your biometric data to uniquely identify you is considered the processing of a special category of personal data. Articulate does not process your biometric data to uniquely identify you.
Under the Illinois Biometric Information Privacy Act (BIPA), "biometric identifier" includes a retina or iris scan, fingerprint, voiceprint, or scan of hand or face geometry. "Biometric information" means any information based on a biometric identifier used to identify an individual.
Under the Texas CUBI, "biometric identifier" means a retina or iris scan, fingerprint, voiceprint, or record of hand or face geometry.

We also act as a Controller when we process personal data generated by your use of the Services for our own legitimate business purposes. If you are an employee or one of our customers’ users, we act as the "Processor" of your personal data transmitted by the customer or collected through the Services on behalf of that customer. That customer acts as the Controller of your information. As a Processor, we do not own, control, or direct the use of any data provided to us or collected on behalf of our customers who act as the Controllers. If you have questions on how your personal data is being handled, please direct your inquiries to our customer, the Controller. If you contact us, we may be obligated to inform our customer of your request.

Custom Photorealistic Avatars and Biometric Data
You may use the Services to create a customized AI avatar (“Custom Photorealistic Avatar”). Articulate is a Processor of the Biometric Data collected through the Custom Photorealistic Avatar feature, and the Customer is the Controller. The Services may inform you before we collect Biometric Data from you in connection with the Custom Photorealistic Avatar feature. If you have questions on how your Biometric Data is being handled, please direct your inquiries to our Customer, the Controller. If you contact us, we may be obligated to inform our Customer of your request.
At our Customer’s instructions as the Controller, Articulate may collect the following categories of Personal Data, including Biometric Data, when using the Custom Photorealistic Avatar feature:
- Facial images and photographs you upload; or
- Biometric Data including facial geometry extracted from your submissions
The Biometric Data you upload is processed for the following purposes:
- Generating your Custom Photorealistic Avatar for use in the Services
- Evaluating the authenticity of submissions for manipulation or unauthorized use
- For security and fraud prevention; or
- As further instructed by the Customer as the Controller
Personal Data We Collect from Third-Party Sources
We may collect business contact information about you from third-party sources, including data enrichment providers, lead generation vendors, event organizers, reseller and channel partners, publicly available sources, and professional networking platforms. This information may include your name, business email address, business phone number, employer, job title, department, seniority, industry, company size, and other business profile or firmographic information. We may also purchase, license, or otherwise obtain business contact information from third-party providers to support marketing, sales outreach, account-based marketing, lead qualification, and reseller enablement. This data enhancement allows us to maintain accurate records, identify prospective customers, and provide more helpful, personalized communication.

Service Providers. Marketing Partners for Purposes of Re-Marketing and Targeted Advertising. We may share your personal data with service providers, vendors and consultants for purposes of re-marketing. We may also share certain identifiers and online activity information with advertising partners for our own marketing purposes. This may include business email address, hashed email address, cookie IDs, device identifiers, IP address, and information about your interactions with our websites, emails, or Services. We use these disclosures to measure campaign effectiveness, create custom audiences, suppress existing customers from acquisition campaigns, and deliver advertisements about our products and Services to you and similar business audiences. Depending on applicable U.S. state law, some of these disclosures may be considered a 'sale,' 'sharing,' or targeted advertising. Co-Marketing and Event Partners. From time to time, we may partner with other trusted companies for joint marketing activities, such as webinars, events, or content promotions. If you register for one of these joint activities, we may share your registration information (such as your name, company, and email address) with our partner for their marketing purposes. This includes sharing lead information with our regional resellers and distributors who may follow up regarding our products and services in your geographic region. We may also receive your business contact information from reseller partners, marketplaces, event sponsors, referral sources, and channel partners where you have requested information, interacted with joint content, or where the partner is permitted to share your information with us.
Affiliated Entities. We may provide your personal data and Usage Data to any affiliated entities we may have, including our subsidiaries. Affiliated entities are entities that we legally control (by voting rights) or that control us.
Successors. If we sell or otherwise transfer part or all of our business or assets to another organization, such as in the course of an acquisition, merger, bankruptcy or liquidation, we may transfer your personal data.
Authorized Resellers. If you contact us, sign up for a trial, webinar, event, content promotion, submit information through our marketing campaigns, or acquire our Services through an authorized reseller or partner, we may share your personal data and Usage Data with those authorized resellers and partners so that they can provide customers with timely, helpful information about our products and the Services. This may include sharing with a reseller your name, business email address, phone number, company name, job title, account interest information, and related lead data where necessary to support your inquiry, quote request, procurement process, deployment, renewal, or regional support. We may use automated systems to route your information to the appropriate regional partner based on your location. In some cases, these authorized partners or resellers act on our behalf as service providers and are contractually obligated to abide by this Privacy Notice and applicable data protection laws, preventing them from sharing your personal data with any other third parties except as permitted. Additional Disclosures. We may disclose your personal data where (1) we believe that disclosure is reasonably necessary to comply with any applicable law, regulation, legal process, or governmental request, (2) to enforce our agreements, policies, and Terms of Use, (3) to protect the security or integrity of our Services, (4) to protect us, our customers, or the public from harm or illegal activities, (5) to respond to an emergency which we believe in good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person, or (6) to respond to claims that any content violates the right of third parties.

We will not retain your personal data for longer than required. In addition, we retain your personal data to maintain the E-Learning Heroes Community history, display any content you contributed, and enable your continued participation. Following deletion of your E-Learning Heroes Community account, any content associated with your account will no longer show your personal data, which will then display “deleted user” as the source. When we delete your personal data from our databases, it will remain in our backup system until it cycles out.
